Congress leader quits over Tytler clean chit, Sikh leaders shocked

Chandigarh, April 3 (IANS) The Sikh community in Punjab Thursday voiced its disappointment over the Central Bureau of Investigation's (CBI) clean chit to Congress leader Jagdish Tytler in a case related to the 1984 anti-Sikh riots, a senior Congress leader quit the party and other leaders condemned the CBI move.

Former Punjab assembly deputy speaker and former Congress legislator Bir Devinder Singh resigned from the primary membership of the Congress party, saying he could not be associated with a party which was siding with perpetrators of violence against Sikhs in 1984.

Hundreds of Sikhs were killed in anti-Sikh riots in Delhi and other places across India following the assassination of then prime minister Indira Gandhi by her Sikh bodyguards in 1984.

Former union minister Tytler, who was accused of leading mobs against the Sikhs, was given a 'clean chit' by the CBI in the riots case.

Tytler, incidentally, is the Congress candidate for the northeast Delhi Lok Sabha seat.

Punjab Chief Minister Parkash Singh Badal termed the clean chit to Tytler as an "outrage against humanity". He said the Congress was trying to decorate known killers of Sikhs with party tickets.

"I call upon the Prime Minister, Dr. Manmohan Singh, to intervene even at this late stage to ensure that the CBI is not allowed to be used as a tool to shield the killers of thousands of innocent men, women and children. His silence at this hour could prove to be a historic failure to discharge his basic constitutional responsibility," Badal said in a statement here.

The Shiromani Gurudwara Prabandhak Committee (SGPC), the mini-parliament of Sikh religious affairs, too condemned the clean chit to Tytler.

"The anti-Sikh attitude of the Congress has again been exposed. It has become clear that the CBI works in tandem with the Congress," SGPC president Avtar Singh Makkar said in Amritsar.

Punjab Deputy Chief Minister and Akali Dal president Sukhbir Badal said that if the National Democratic Alliance (NDA) government, of which the ruling Akali Dal is a partner, was voted to power, the cases against Tytler and other leaders who led the anti-Sikh riots would be re-opened and investigated.

Radical Sikh group Dal Khalsa also condemned the CBI move to favour Tytler.

"This is shocking. It clearly shows that laws for one community in India are different compared to the minorities," Dal Khalsa leader Kanwarpal Singh said.

Sikhs protest as CBI clears Tytler in 1984 riots case

New Delhi, April 3 (IANS) Congress' riot tainted Lok Sabha nominee Jagdish Tytler was Thursday cleared by the Central Bureau of Investigation (CBI) in a case related to the 1984 anti-Sikh carnage in Delhi, prompting protests by upset Sikhs and raising questions about its timing.

In its final report in the case to a court here, the CBI pleaded that the case against Tytler, the Congress' candidate from the Delhi Northeast constituency, be cancelled on grounds that the affidavits by two people - Surender Singh and Jasbir Singh - were inconsistent and contradictory.

In January 2002, Surender Singh stated before the Justice Nanavati Commission probing the riots that Tytler had on Nov 1, 1984, incited a mob to burn a gurdwara and kill Sikhs. This was retracted in August 2002, the CBI said in its statement.

The second witness, California-based Jasbir Singh, who was earlier declared untraceable by the CBI, had stated that on Nov 3, 1984, he had overheard Tytler commenting on the killing of Sikhs in his then constituency Sadar Bazar.

"... The analysis of all the evidence on record revealed that their statements were inconsistent, unreliable and unworthy of credit," the CBI statement said.

The victims' lawyer H.S. Phoolka submitted before the court that he wanted to inspect the final report. After hearing him, the court asked the CBI to give its reply by April 9.

Reacting strongly to the CBI's clean chit, Phoolka, who has spearheaded one of the longest and most tortuous legal battles to gain justice for the victims of the 1984 riots, said the verdict was "upsetting".

"Ever since the case went to the CBI, the agency has been eager to give Tytler a clean chit. We will not give up our fight yet," said Phoolka.

"It is sad to see that even before the seal of the final report was opened, Tytler knew that he had got a clean chit."

As the CBI decision was made public, hundreds of Sikhs who had gathered outside the court premises protested. They raised slogans against the Congress, the CBI and Tytler as well as other senior Congress leaders like Sajjan Kumar, who is contesting from the South Delhi constituency, for their alleged involvement in the riots.

"Despite this move by the CBI, we will continue our fight against the accused till our last breath. Our trust in the premier investigating agency is shattered," said Amrit Singh Lovely, a victim of the riots.

This case was one of the seven cases registered by CBI relating to 1984 anti-Sikh riots - in which more than 3,000 people, of them 2,000 in Delhi alone, were killed in the immediate aftermath of the assassination of then prime minister Indira Gandhi by her Sikh bodyguards in October 1984.

The home ministry had taken the decision to hand the investigation to the CBI after examining the Justice Nanavati Commission report submitted in 2005.

The timing of the clean chit - just before the general elections - led the opposition Bharatiya Janata Party (BJP) to question its timing.

"The CBI has once again proven itself to be the Congress Bureau of Investigation," said BJP spokesperson Prakash Javadekar, labelling it a politically motivated case.

Tytler was among the three prominent Congress leaders accused of having incited mobs. The two other leaders named were Sajjan Kumar, who is contesting from South Delhi, and the late H.K.L. Bhagat.

But the Congress, which has battled the charges for 25 years, refused to comment.

Donning the role of party spokesperson, Home Minister P. Chidambaram said: "The CBI has submitted its report. It would not be appropriate to comment on it as the matter is subjudice."

Tytler, however, was jubilant.

"It is the media which has been keeping the issue alive. I am happy today that truth has prevailed. I will fight the election and I am hundred per cent sure that I will get the votes of all sections of the society."

Wahe Guru Ji Ka Khalsa Wahe Guru Ji Ki Fateh It is very sad and unfortunate that perpetrators of 1984 carnage have not been brought to justice. However it is not surprising, anyone who knows Indian judicial and political system will know that politicians and rich always seem to escape judicial punishment. This is true for all politicians irrespective of their religion. I am told that things are no different other developing countries. I feel if SGPC or Delhi Sikh Gurdwara Management Committee (DSGMC) had put in all their might behind this case then the verdict could have been different. My friends from India will remember that famous lawyer Ram Jethmalini (a Hindu) unsuccessfully defended Satwant Singh and Kehar Singh generating lot of controversy among Congress and certain other sections but Jethmalini was able to raise some public opinion even in the pre-cable/internet era. The government got lot of flak from the press and Non - Sikhs Intellectuals when it decided to hang the alleged conspirator Kehar Singh. We live in an information era, the DSGMC should have hired a top notch lawyer and publicist to created public opinion and could have provided protection to all witnesses. DSGMC could have generated funding for the case and I am sure Sikhs all over the world would have contributed but alias people from East (India & other Asian countries) take pride in caring and looking after their parents and extended families but have little sense for community welfare and cohesion. This is an admirable quality but unfortunately this is the main reason for nepotism and corruption in our political/legal system. I am sure Wahe Guru will bring these perpetrators to justice although we may not understand his way.

Dear Mr. Tytler. Heartiest congratulations. This drama is finally over. You have been proven innocent. I am extremely happy for you. You see we knew that this was all a drama by India's judicial system (I am reluctant to use the word system here since it does not really exist you see). Now that the drama is over you can go back and get that Delhi seat of yours. This way you may start building your bank balance - it must have been difficult for you to "serve" your assests (oops I mean country) by sitting at home. Damn that Manmohan he had some guts to apologize for your alleged actions. These Sikhs are so stupid, no wonder the RSS is able to able to successfully Hinduize them - they thought they could actually send any politician to prison for his / her actions. Na na big mistake. How could they do so, 25 years on and they still seem to be living in Maharaja Ranjit Singh's times expecting justice - HAHA. There was great hope of

There was great hope of justice after case was reopened by CBI. Judiciary is not incompetent or corrupt but legal process needs input on record which is of course uphill task in cases of riotings. It becomes difficult for investigating agencies to pin point the real culprits with documentry evidence. Judiciary becomes a mute and helpless spectator in the absence of documentary evidence. It is a great pity and disappontment. It is true that relatives of victims will loose confidence in law of the land. I request them to not to loose confidence in law of nature and HIM, the creator of the nature. "JUSTICE" will be delivered sooner or later in one way or another.

Ramesh kr., The way law works for and against minorities ( specially Sikhs) in India, it seems not to be a matter of lack of documentary evidence but on the contrary from reports it appears that it is a complete lack of the will to stand for justice on the part of CBI (perhaps on the behest of government, it does not matter whether it is BJP/CONGRESS). 'Judiciary is not incompetent', maybe a correct statement when working against Sikhs. (Take BHULLAR's case for example). About corruption in judiciary I better not say anything. "JUSTICE will be delivered sooner or later in one way or another." is the commonest statement given by political persons in an attempt to soothe the hurt of injustice metted out to minorities (namely Sikhs).

What else a common man say except showing solidarity and sympathies ? Can you please elaborate what exactly do you expect a common man to write in response to this news ? Shall I start abusing JT,CBI,GOI,POLICE, JUDGE,LAWYERS,THOSE CRIMINALS ? Is that going to serve any purpose ? If yes, I will do that right now. Come on Mr. Romesh, you are no common man, you are one of the few regular ones on this forum. I have been reading your comments with interest for quite some time now and your feelings and thinking becomes quite obvious from the content therein, i.e. solidarity and sympathies with HINDUS alone. Whatever may be the issue, you finally end up standing for the majority and against the Sikhs, for e.g. see the contempt in one of your comments ~~~ "Any crime committed by so called minorities in India against state or humanity is not a CRIMINAL OFFENCE, definition of criminal offence in pseudo-secular India is any lawful or unlawful or natural response/reaction to that criminal offence." Nobody wants you to abuse CBI, JT, GOI or any other agency but we do expect you to realize that whatever and whenever Sikhs have done anything it was a just a poor show of retaliation to the unfair and unjust actions of Majority Hindu Governments. Romesh ji, it is the blessings of our Gurus that Sikhs come out stronger and more determined after every unjust and unfair action taken against them.

Beta Romesh Kumar - why do I say Beta is bcoz I have now known that your knowledge is very limited in these affairs. Please read the post carefully and you will see that there is no nafrat for sare jahan - there is only nafrat from rats such as Jagdish Tytler and communal forces. If Sikhs had hatred they would have never served their country India faithfully. We have, we are and we will always be loyal. In fact most Hindus will tell you that they cringe when questioning any Sikhs loyalty. We ask for Chardi Kala and Sarbat da bhala in millions of ardas everyday across the globe. You however my friend need to come clean and accept this fact and the other facts as stated in my forum. Your last post clearly tells me that you have nothing left to argue about. So why not accept the truth after all truth is the only alive thing in the world and has an uncanny way of showing up in places least expected.

As you rightly said that I do not know much about these things, I honestly admit this fact and that is why we like to read and write to know more and more from people like you. You being a sikh should have known that sikh literally means a learner, a follower a disciple. Sikh is local/punjabi pronounciation of Sanskrit word SHISHYA. As you know a lot you must be aware of the fact that Sanskrit is mother of all languages and scripts in Indian subcontinent and beyond. I am impressed with your display and show of loyality towards your motherland-India. In fact it is not even required to be shown or talked of, it is natural and obvious as India is motherland of sikhs. It is moral duty of citizens towards their motherland unless someone is a traitor. So do not expect Indian nation to take it as a special favor or support. Secondly, this nation has such a strong foundatioon that she has survived all the assasins for milleniums. She has seen different ages, eras, circumstances, good/bad times and situations for milleniums. Sikhism is a three centuries old story. Sikhism came as a philosophy, an ideology, a revolution, a resistance against oppressive mughal regime of aurangzeb in a part of north-west mughal India and of course changed the equations. What was happening and happened in other parts of India ? Pls try to read History of India to know it. How can someone say that sikhs brought/gave freedom to India ? Did sikhs come from other planet or any other continent to India with sole purpose of liberating India ? They are sons of the soil. And why tamils or gujarati or marathi should have come to rescue punjabis in punjab from mughal opression ? They were doing more or less same to their capacity in their own way in other parts and regions of India. Same thing apply to freedom struggle from british. Can you tell me how did british succeed to capture whole of India and punjab as well in1857 in the full view of sikhs ? You might have been to Trafalgar Square, London and might have read what is written under Majoe General Havelock's statue. Bottom line is that all the communities with exception of none have contributed to their capacity and expertise to bring Indian nation to a state where we are in. To quote of GANGU or CHANDU speaks nothing except your 'madarsa' type of education and upbringing. He was personal servant, follower and disciple of Tenth Master, hence a SIKH. Another hindu baniya who made most costliest land deal on the earth to pay for a piece of land to cremate younger Sahibzadas was not follower or disciple of Tenth Master. It is individual's character which necessarily does not represent a community. Gangus and chandus do not represent more than one billion indian and NRI hindus in world nor these one billion plus people need a special class or community of people in India or abroad to help/protect them. Guru sahibans had sacrificed for a cause, what is happening today is opposite of that cause. There were no separate sikhs at the time of abdali, those women were punjabi, you can not call them hindu girls alone. There is no ban on calling marriage an anand karaj or vivah or shadi nor state advises the procedure of marriage ceremony to any of the faiths, act covers the socio-legal side only which is based on similiarities and commanalities. It is natural and of course painful that some innocent and ignorant people are killed when caught in cross fire between terrorists and security forces. Who were those two servants who followed Tenth Guru Sahib to Nanded and stabbed him ? We have lost half of Indian territory in east and west including more than half of punjab and birth place of First Master to the descendants of those two. After independence, religious color was added to all demand of punjabis and punjab ignoring hindu majority, making all the demands 'case sensitive' hence unfulfilled. Extreme elements joined hands with descendants of mughals against hindus and Indian state killing tens of thousands and displacing hundreds of thousands in Punjab. This led to army intervention in Punjab, followed by backstabbing of Prime Minister resulting in most henious 84 riots and so on. This is the other side of coin I meant, bujurag ji.

God's justice

will eventually prevail for this sinner (his face clearly reveal the evil in him) and all of us if we are indeed to be compared to his level but I have no doubt that we Sikhs never have and will never stoop to his level of killing innocent babies, women, and the biggest sin of burning our Gurbani and gurdwaras...just please remember fellow sikhs, do not think of revenge but just that prayer is the most divine and powerful weapon against all evil so just keep up with ardas, naam simran and Patsahi 10 Kabyo Bach Benti Chaupi! Raj Karega Khalsa!
